Watch out for Free Trials

Lately MagicPuffer has been gaining new customers who have a complaint about other companies they have used in the past – free trials that aren’t really free. I continue to hear stories through email and on the phone about a customer signing up for a free trial, only to be billed monthly for refills or other products. Be wary of free trials being offered for electronic cigarettes and be sure to check for any fine print.

So whats happening? The main complaint is a free trial is offered – that requires shipping to be paid with a credit card. In 2 – 3 weeks a refill is sent and automatically charged to your credit card with out ordering the product. It is then hard to get out of this recurring billing and the company becomes hard to contact. So if you ordered a free trial, watch your credit card statement and if you have problems contacting the company you purchased from, be sure to contact your bank.

MagicPuffer does not offer any type of free trials. We do back our Starter Kits with a one year warranty, so if something breaks send it back and we will repair or replace it at no charge in the first year.

Judge rules FDA has no Authority over Electronic Cigarettes

Today there has been some excellent news about Electronic Cigarettes. A U.S. District has ruled the FDA does not have authority over Electronic Cigarettes and can no longer attempt ban or seize imports and shipments containing Electronic Cigarettes. This is excellent news for the entire Electronic Cigarette industry and all user’s of these products. The FDA has seized shipments of Electronic Cigarettes in the past causing shipping delays and other problems.

The judge criticized what he called the FDA’s “tenacious drive to maximize its regulatory power,” saying he found its interpretation of the law “unreasonable and unacceptable.” “This case appears to be yet another example of FDA’s aggressive efforts to regulate recreational tobacco products as drugs or devices,” he said in granting an injunction barring the FDA from regulating the cigarettes as a drug-device combination. As an Electronic Cigarette maker and distributor, Magic Puffer expects faster shipping and less delays for all customers.

Magic Puffer is a brand of high quality electronic cigarette, or “e-cigarette”. These are battery powered devices that taste, feel and are an alternative to smoked tobacco products like cigarettes.

Our products use propylene glycol, a common food additive, and unless stated otherwise include nicotine diluted in the solution. We sell pre-filled and sealed cartridges so you do not need to go through the hassle of trying to refill your own cartridges.

N.J. Assembely Passed E-Cigarette Restrictions

Well it could be worst – such as an outright ban. The NJ Assembly Bill (http://www.njleg.state.nj.us/2008/Bills/S3500/3053_U1.HTM) adopted Dec 7th 2009 bans e-cigarette use indoors and the sale of e-cigarettes to minors.

Magic Puffer is located in Secaucus, New Jersey and as such the NJ Assembly law applies to our company. However no changes in our business will take place, as we have sold our products only to people who are of the legal smoking age in their state. New Jersey restricts the purchase of Tobacco products to consumers over the age of 19 and thus MagicPuffer sells products to people over 19 who live in New Jersey (18 in most other locations in the US).

E-Cigarettes contain nicotine, are inhaled and look like cigarettes – but that is where the similarity stops. An E-Cigarette does not contain tobacco leaves nor is it burned. Exhaled is a water vapor that looks like smoke.

Magic Puffer welcomes clear regulations on the sale of E-Cigarettes in New Jersey. Based on these regulations of limiting purchases to consumer’s over 19, we feel it is time to release additional flavors for our products. Previously only three Tobacco based flavors were sold because there were no regulations on E-Cigarettes, and we did not want to appear to be marketing to any one younger than smoking age.

MagicPuffer is now offering Camel, Chocolate, Coffee, Dunhill, MaRed, Menthol, Strawberry, and Tobacco as refillable flavors for our Starter Kit. Additional we have released a Menthol flavor for our Disposable E-Cigarette.
